DRUG LAWS
This
issue of Currents highlights the profession’s concern with the numerous
inequities that have resulted from the Rockefeller Drug Laws (RDLs).
• In 2004, there were over 17,000 drug offenders in NYS prisons.
Over 33% are there for drug possession, not for drug selling.
• This population is comprised of 51.8% African Americans; 40.8%
Latinos; 6% Whites. Whites, However, the majority of drug users and sellers
are white.
• In 1973, when the RDLs were enacted, there were 400 women in NYS
prison; 100 for drug offenses. In 2004, there were 2,900 women in NYS
prison; 1,150 for drug offenses. Nearly 87% were African American and
Latina.
• In 2002, over 80% of NYS women prisoners reported a substance
abuse problem prior to arrest.
• Children of substance involved inmates are at high risk of both
addiction and incarceration.
• 12,000 children have a mother incarcerated in NY jails or prisons.
